Relatives of the deceased filed a lawsuit against Kirkorov. The proceedings lasted about 6 years. The jury's votes were distributed in a percentage ratio of 49% to 51% in favor of the singer. The advantage was minimal, so Philip remained free.

“Now, even when going abroad on tour, I have to carry all my people. But then everything was different for me. During my solo show at the Taj Mahal, which took place in a huge hall for 10 thousand people, two security guards were assigned to me. They had to keep order. The man who was placed in the front line was 60-70 years old. When I walked towards the audience, and the stage was very high, and began to descend from the stairs, the lighting operator did not illuminate the hall. But I continued moving anyway - into the darkness, by touch. Naturally, I was blinded by the spotlights. The song was very dynamic. I moved very energetically and, going down the stairs, came face to face with an obstacle in the form of a man and instinctively threw him away. It happened purely intuitively. I moved on, and then it turned out that the man fell on his back. But I didn't see it. “I didn’t even realize that he fell,” Philip Kirkorov recalled the accident that happened during his concert.

“The decree says that a man fell down the stairs, hit his head on the concrete floor and lost consciousness, and you didn’t even come up to him,” read Lera Kudryavtseva official document. “I didn’t understand what happened because it happened in complete darkness. After the concert they told me with a chuckle that I had knocked over a security guard. The organizers assured that everything was fine with him. He was taken to the hospital with a bruise to his arm and head. After this injury, the security guard stopped going to work and after six months or a year he was gone,” said Philip Kirkorov.

The guard's name was Thomas Rogers. On March 18, 2009, he died of a stroke following open heart surgery. “I didn't know anything. They didn't even tell me that he was hospitalized after the concert. And as the investigation later showed, open heart surgery happened much later. His relatives filed a lawsuit against me. I'm in once again I came to a concert at the Taj Mahal and an American bailiff came to me with a summons that I was being summoned to court. Relatives wanted to know the truth. They sued the casino where the show took place, the concert organizers, me, and the fact that the employers did not protect the employee from an accident. All these long six years, investigative experiments were carried out. Every six months I had to go to them. I came to investigative experiments and proved my innocence all these years. It was extremely unpleasant to testify and make excuses. Still, I blame myself... If I had not collided with him then, the uncle would not have fallen and would still live and live. But in court they proved that I really didn’t see him,” Kirkorov said.

The investigation into this criminal case lasted for six years. As a result, in 2009, the jury acquitted the singer, although with a margin of only two votes: 51 for and 49 against the singer’s innocence. The court ruled that Kirkorov was partially to blame for the tragic incident with Thomas Rogers, but the security guard himself made a mistake by violating instructions on the rules of working at the concert.

For many years the story was hushed up because trial, initiated by the relatives of the late Thomas Rogers, took place in American state New Jersey. As life.ru learned, which obtained documents from the court, Kirkorov’s show was then held at Donald Trump’s Trump Taj Mahal casino.

During the concert, Kirkorov, going down into the hall to the audience, pushed away a 70-year-old security guard. The man fell, hit himself hard and lost consciousness. The security guard needed an urgent medical care. The man survived, but then suffered from severe pain for several years. In 2009, during another operation, he died.

In court, Kirkorov justified himself by saying that, while descending from the stage, he did not see the security guard due to the bright light and instinctively pushed away the “obstacle” on his way. However, colleagues of the deceased claim that the singer did this deliberately, grabbing the guard and pushing him with his hands. In addition, when the man fell, Kirkorov not only did not try to help him, but laughed at the guard lying on the floor.

Witnesses also complained that after the incident they were not allowed to get closer to Kirkorov and his entourage. Representatives of the security guard's family were forced to contact the police with a demand to investigate the case.

As a result, the court announced that Kirkorov was partly to blame for the tragic incident with Rogers, and also admitted that the guard suffered, among other things, due to his own actions, which violated the instructions while working at the concert. In fact, the Russian singer was acquitted. On September 10, 2009, the jury ruled that Kirkorov did not attack or beat the security guard.

Rogers' family appealed. The court of second instance drew attention to controversial issues and possible “jury errors”, but due to US law, it left the decision of the first instance court unchanged. However, the relatives of the deceased security guard still blame the singer for the incident.
