A bill of lading is a document confirming the conclusion of a transportation agreement: in a situation where the goods are delivered by an engaged carrier. Since 2011, new Rules for freight transportation by road have been in force on the territory of the Russian Federation, which were approved by Decree of the Government of the Russian Federation dated April 15, 2011 No. 272 ​​“ On approval of the Rules for the transportation of goods by road"(hereinafter referred to as Rules No. 272). This document (Appendix 4) also approved the form of the consignment note and the rules for filling it out. Let's look at an example of how to use them.

In what cases do we issue and in what cases do we not issue a waybill?

You need to fill out an invoice:

  • in a situation where the goods are delivered precisely by the contracted carrier on the basis of a contract of carriage;
  • if the goods are delivered by a forwarder and an agreement and the forwarder is required to enter into a transportation agreement (the forwarder acts as the sender).

If the contract is not concluded and the buyer removes the goods from the sender’s warehouse using his own transport, then transportation services are not provided and the invoice is not drawn up.

Requirements for filling

The sample for filling out the new 2019 bill of lading must take into account the requirements of Regulation No. 272.

  • The consignment note is a document confirming the conclusion of a transportation agreement (clause 6 of Rules No. 272).
  • Unless otherwise provided by the contract of carriage, the invoice is drawn up for one or more consignments of goods transported on one vehicle.
  • 3 copies (originals) of the waybill are drawn up for the shipper, consignee and carrier, they are signed by the shipper and carrier or their authorized persons (clause 9 of Rules No. 272).
  • The consignment note, unless otherwise provided by the contract, is drawn up by the shipper (clause 6 of Rules No. 272). The sender can be both the supplier of goods and their buyer, persons authorized by the seller and buyer, as well as a forwarder.
  • If corrections are made to the document, they must also be certified by the signatures of both the shipper and the carrier or their authorized persons (clause 9 of Rules No. 272).
  • In the case of loading cargo to be transported onto various vehicles, a number of invoices should be drawn up that corresponds to the number of vehicles used (clause 10 of Rules No. 272).

Persons who sign the document must be authorized by valid powers of attorney or official duties.

The order of filling in sections

The form consists of 17 sections:

1. Provide information about the shipper: name, address, bank details, full name, location address, telephone number.

2. The same data is indicated, but about the consignee (we repeat: name, address, bank details, full name, location address, telephone number - see sample).

3. The name of the cargo being shipped, its condition and other necessary information about the cargo, the number of pieces and net or gross weight, dimensions are recorded.

4. The accompanying documents for the cargo are indicated. These can be documents of title, various certificates, passports, certificates, permits, etc. For example, as shown in the sample, a delivery note and quality certificates.

5. If necessary, special requirements for cargo transportation are included: parameters of the vehicle, information about locking and sealing devices, declared value (value) of the cargo, required temperature, volume, etc.

6. Information about the acceptance of cargo for loading (address, date, time, weight, quantity, actual condition - see sample). The signatures of the driver and the shipper are affixed with a transcript of the signature and an indication of the position.

7. Information about the delivery of cargo for unloading (address, date, time, weight, quantity, actual condition). The signatures of the driver and the consignee are affixed with a transcript of the signature and an indication of the position.

8. Conditions of transportation. Enter or select from those presented, special conditions of transportation or temporary warehousing, information about the penalties provided for in the contract of transportation.

9. Information about acceptance of the order (application) for execution is indicated.

10. Data about the carrier is entered: name and address of location, telephone number, full name and telephone number of the driver.

11. Information about the vehicle is entered: quantity, type, make, carrying capacity, registration numbers.

12. The carrier fills in data on the actual condition of the cargo, packaging during loading and shipment, and possible changes in transportation conditions during movement.

13. Other conditions are indicated if necessary: ​​when transporting dangerous, temperature-sensitive, oversized cargo; The driver’s work and rest schedule along the route is recorded.

14. To be filled in if the place of delivery of the goods has changed.

15. The cost of cargo transportation services, the procedure for calculating and the amount of freight charges, and the carrier’s expenses presented to the shipper are reflected. The full name of the payer's organization (shipper), address, and bank details of the payer's organization (shipper) are also indicated.

16. The date of preparation and signatures of the parties (shipper and carrier) are indicated.

17. Here you can enter violations during cargo transportation and claims from the shipper, consignee, and carrier.

If there is no information to fill out in a particular section, dashes are added (see sample).

Rules for filling out the Consignment Note

The “consignment note” must be drawn up in triplicate. Each copy is assigned its own serial number. All of them must be originals, that is, each must have “wet” seals and original signatures. Erasures, any corrections and blots are unacceptable.

The consignment note contains separate lines for the consignor/consignee - a legal entity or an individual (paragraphs 1 and 2).

Important innovation! The new waybill does not have a table with goods. It indicates only the name of the cargo, its volume and markings. The quantity and price are not indicated (point 3).

Other items of the new invoice:

Clause 4. Accompanying documents for the cargo: certificates, quality passports and other supporting documents.

Clause 5. Instructions of the shipper, namely the required capacity of the vehicle, the required recommendations on temperature conditions during the transportation of goods, and others.

Clause 6. Date and time of delivery of vehicles for loading in accordance with the contract, as well as the time of delivery of vehicles in fact.

Clause 7. Date and time of delivery of vehicles for unloading - according to the contract and time in fact.

Clause 8. Conditions of transportation. This paragraph may remain blank if the cargo is transported under the conditions provided for by the “Charter of Road Transport and Urban Ground Electric Transport” and the new Rules.

Clause 9. This clause is completed by the carrier himself.

Clause 10. The full name of the person responsible for the transportation, the full name of the driver of the vehicle and information about their means of communication are indicated.

Clause 11. Information about the vehicle is indicated: carrying capacity is indicated in tons, capacity in cubic meters.

Clause 12. The carrier can indicate his personal comments and observations: about the actual condition of the cargo, its markings, etc.

Clause 13. This clause is completed in case of transportation of goods requiring special permits (large, explosive, heavy cargo).

Clause 14. To be completed by the carrier if the cargo delivery address has changed during transportation.

Clause 15. Indicate the final cost of transportation services and the procedure for calculating freight charges.

Clause 16. Indicate the date of preparation, as well as the signatures of one and the other party.

Clause 17. To be completed if the terms of the agreement were suddenly violated. A note is placed on the completed violation report.

TTN form 2015-2016 (Russia)

In 2016, it is used on the territory of the Russian Federation form of consignment note 1-T, approved back in 1997. After approval, no other changes were made to the document form, but confusion may arise due to the adoption of the consignment note (Government Decree No. 272 ​​dated April 15, 2011).

However, today both forms of documents - TTN and waybill - operate in parallel. The main difference between the waybill and the 1-T form is that the first does not have a product section and when indicating the goods the price is not indicated - there is only the possibility of indicating the declared value. Which form of these two should be used and when? The general rule in this case is the following: when transporting on your own (by the buyer or supplier), a TTN is issued, but if the cargo is carried by a third-party carrier or is in transit, then Form 1-T is used.

The confusion with the use of document forms when registering the transportation of goods is caused by the fact that the Ministry of Finance, by its letter dated November 6, 2014 No. 03-03-06/1/55918, established that in order to confirm the contract for the carriage of goods, it is the consignment note that is required. This means that, in the opinion of the Ministry, transportation costs can only be confirmed by a consignment note filled out in accordance with the form approved by Government Decree No. 272.

However, there is also an explanation from the tax service on this matter. The letter of the Federal Tax Service dated March 21, 2012 No. ED-4-3/4681@ directly states that to confirm transportation costs when calculating income tax, you can use both the 1-T form and the invoice form.

Therefore, if it is more common to issue waybills, or the enterprise uses the TTN and does not fill out TORG-12, then there is no need to change anything and switch to a new form of transport documentation. Besides download TTN(and absolutely free) on any accounting website.

Nuances of filling out the TTN

The shipper is required to prepare waybills for each vehicle trip. It does not matter whether the vehicle is the property of the consignor or whether he used the services of a third party to provide transportation services. TTN, download the form, which can be found on any accounting website, is compiled for each consignee separately. This should also be followed in the case when all these inventory items are moved simultaneously in one vehicle.

For the driver, in accordance with the traffic rules, the TTN is the main document that must be presented for the cargo when checked on the road by traffic police officers. In the absence of this document, the entire cargo may be seized until the circumstances of the delivery are clarified.

Invoices are drawn up in four copies. In this case, the first copy with the driver’s signature confirming receipt of the cargo remains with the shipper. In case of loss or damage to the cargo in transit, according to this document, the sender of the cargo will be able to recover material damage from the transport organization carrying out the transportation of this consignment. After all, when signing the consignment note, responsibility for the safety of the cargo is transferred to the transport organization.

The remaining three copies of the TTN follow along with the cargo. The second copy is given to the shipper upon acceptance of the goods. The shipper makes a note about the presence or absence of claims and signs the document (all three copies). Subsequently, the transport company returns one copy of the TTN, signed by all parties, to the shipper along with documents on transport services.
